Notice of Changes to our Savings Account Terms & Conditions

This notice summaries changes we have made to our Terms and Conditions applying to our savings accounts with effect from 31 October 2009, they reflect new Payment Services regulations which have been introduced.

  • General Terms and Conditions applying to our savings accounts
  • Product specific terms and conditions
  • Internet Terms and Conditions.

These changes are mainly to reflect new regulations which have been introduced and are designed to provide additional benefits to customers. The main changes that affect you include:

  • Our and your responsibilities in operating your account; and
  • Information you require to make payments and receive payments into your account;

We have made some other changes at the same time; for example to reflect other changes in regulation that we are expecting.

Changes to the General Terms and Conditions

  • We have changed the layout by numbering more paragraphs and reordering them so that paragraphs about the same issue sit together and to make it clearer how the different paragraphs interrelate.
  • We have added some new definitions. (condition 1.4)
  • You can now make partial withdrawals/transfers from your ISA unless the specific terms and conditions for the account say you can’t. (condition 4.1.9)
  • We have limited the circumstances when we can restrict or withdraw the use of a CashCard or the Telephone Service. (conditions 5.2.1 & 6.2.5). We have told you how and when we will inform you of this and how and when we will tell you if we restrict the amount that can be withdrawn from your account or we refuse an Electronic Payment. (conditions 5.2.1, 6.2.5 and 7.6)
  • We have confirmed the currency of your account is sterling and you cannot make payments into or payments from your account by cash in any other currency. (Condition 7.2). Electronic Payments can be made to or from your account in a currency other than sterling where the specific terms of your account permit Electronic Payments or we otherwise agree.
  • In relation to Electronic Payments we have explained :
    • What information you will need to give in order for a payment to be made to or from your account and our responsibility to you if that information is incorrect. (conditions 7.16.3, 7.17.1 & 7.18)
    • How long it will take for an Electronic Payment from your account to be received by the bank/building society it is being sent to and the time by which you must request the payment to be made in order to achieve those timescales. (condition 6.3.4, 7.16.1, 7.16.2 & 7.18)
    • How you can find out more information about Electronic Payments to or from your account. (condition 7.1)
    • Where different conditions apply for electronic payments sent overseas or received from overseas. (condition 7.16.4, 7.16.5 & 7.17.3)
    We have changed how and when we will tell you about changes to interest rates, charges and terms and conditions. This will depend on the type of account you have and where we are changing/introducing a charge or condition what it relates to. (condition 8.4, 11.6 & 12.3)
  • We have given guidance on the reasonable security precautions you should take to prevent the misuse of your account. You may be liable for the unauthorised use of your account if you don’t follow this guidance. (condition 9)
  • We have amended the condition on when we can close your account without notice. (condition 13.5)
  • We have set out when you will be responsible for transactions which have not been authorised by you. (condition 15)
  • We have updated the summary of when the Financial Services Compensation Scheme applies. (Important Information paragraph 1)

Specific Terms and Conditions

The Specific Terms and Conditions of the DirectSaver and DirectSaver Reserve account have been amended to remove the clause which says we cannot be held responsible for funds properly sent by us that are not received in the Linked Current Account. Our liability for this is now set out in 7.16.3 of the General Terms and Conditions.

The terms and conditions of the Offset Mortgage/Britannia Savings Mortgage – Linked Savings Account have been amended with conditions 20.6 to 20.56 of the 'Britannia Savings Mortgage Offer - General Conditions' being deleted and replaced with conditions :

  • Incorporating the General Terms and Conditions (condition 20.12)
  • Making it clear that it is a Payment Account (condition 20.6)
  • Replacing terms and conditions which are specific to the Linked Savings Account and were previously in conditions 20.6 to 20.56. (conditions 20.7 to 20.11)

Internet Terms and Conditions

We have changed the terms and conditions which apply to Online Servicing and internet managed services to:

  • Explain how you access the service
  • Cross refer to guidance in the General Terms and Conditions on Security and your liability for unauthorised transactions
  • Limit the circumstances when we can restrict or withdraw the use of the service and explain how and when we will inform you of this.

** Football Save and Support Adult and Football Junior Saver Accounts are available with the following clubs - Manchester United, Chelsea, Liverpool, Everton, Tottenham Hotspur, Ipswich Town, Bristol City, Arsenal, Stoke City, Sunderland, Port Vale, Manchester City, Bristol Rovers.
